Terms of Service

By accessing or using ShiftPouch.com, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the site.

1. Eligibility

You must be 18 years or older to purchase from ShiftPouch.com. Our products contain zero nicotine and are designed as behavioral tools, not tobacco or nicotine cessation products.

2. Product Use

Shift pouches contain 0.0 MG nicotine. They are not evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease. Use at your own discretion and consult a healthcare provider if needed.

3. Orders and Payment

All orders are subject to acceptance and availability. Payment must be made at the time of purchase using secure checkout systems. We reserve the right to cancel or refuse any order at our discretion.

5. Intellectual Property

All content, branding, and design elements on this site are the property of Shift or its licensors. You may not use them without written permission.

6. Limitation of Liability

To the fullest extent permitted by law, Shift is not liable for any indirect, incidental, or consequential damages related to your use of the website or products.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes shall be resolved in Texas courts or through binding arbitration if mutually agreed.

RIGHT OF REVOCATION

The Customer has fourteen (14) days from the day of receipt of the Products ordered to exercise its right of revocation, without providing any reason.

The Customer will inform Sahara of its decision to revoke by sending a straightforward and explicit declaration to Customer Service, Ellermanstraat 14, 2000 Antwerpen, Belgium or by e-mail: service@sahara.com. The Customer can use the model revocation form attached in the Annex to these Terms, but this is not mandatory.

The Customer shall return the Products to Sahara immediately and in any case, at the latest fourteen days after having communicated the decision to revoke. The Customer must return the Products in a new and unused condition, with all the original labels on, and at his expense. In certain countries, Sahara may provide return labels for free returns. If not, the Customer will bear responsibility for the Products (including damage or loss) until it reaches Sahara.

 In case the conditions above are fulfilled, and Sahara has received the Products, Sahara will refund the Customer the entire sum of the order, including the purchase price and transportation costs (other than additional charges arising from the Customer’s choice of a different method of delivery than the least expensive type of standard delivery offered by Sahara).

The total purchase price (including the standard transportation costs) will be refunded within 14 calendar days of Sahara receiving the returned Products in good time, provided all conditions as specified above have been strictly complied with. Under no circumstances can the amount repaid ever exceed what the Customer actually paid.

 The Customer will be refunded in accordance with the procedures agreed with the bank which issued the card. For this refund, Sahara will use the same means of payment as the Customer used for the original transaction unless expressly agreed otherwise. The Customer will not be charged for this refund less the sales vouchers or discounts used to pay for the order.

The Customer shall be liable for any loss in value of the Products if such loss in value is due to having used the Products to an extent more than necessary to establish the product's nature, characteristics, and functioning.

Returns can only be accepted as described above, and returns to our physical stores will not be accepted.
